Terms and Conditions

These Terms and Conditions constitute a legally binding agreement between you and Nathan Cataldo, doing business as Wildcat Systems (“Wildcat Systems,” “we,” “us,” or “our”), concerning your access to and use of www.wldctsystems.com, including its webpages, online storefront, content, services, and products, collectively referred to as the “Site.”

By accessing the Site, creating an account, submitting an order, or purchasing a product, you agree to these Terms and Conditions. If you do not agree to these Terms and Conditions, you may not use the Site or purchase products from us.

1. Eligibility

You must be at least 18 years old and have reached the age of legal majority in your jurisdiction to purchase firearm-related products from the Site.

By submitting an order, you represent and warrant that:

- You are legally capable of entering into a binding agreement.
- You are legally permitted to purchase, possess, receive, install, and use the products ordered.
- Your purchase and intended use comply with all applicable federal, state, and local laws.
- You are not purchasing for an unlawful purpose or on behalf of a person who is legally prohibited from receiving the product.
- All information submitted during checkout is complete and accurate.

We may refuse or cancel an order when we reasonably believe that the order may violate applicable law, these Terms and Conditions, the requirements of our payment processor, or our internal compliance policies.

2. Products Sold

Wildcat Systems sells firearm accessories, equipment, components, and related products. These products may include:

- Non-serialized pistol chassis systems.
- Non-serialized grip modules.
- Stripped upper receivers that are not legally classified as serialized firearms.
- Magazines and magazine components.
- Rail sections, mounts, and attachment hardware.
- Communications and load-bearing equipment accessories.
- Replacement components and related equipment.

Unless expressly identified otherwise on the applicable product page, products sold through the Site are not firearms, serialized frames or receivers, ammunition, suppressors, machine guns, or other items regulated under the National Firearms Act.

Product classifications and laws vary by jurisdiction. The customer is solely responsible for determining whether a product is lawful at the shipping destination and in every location where the customer intends to possess, install, or use it.

3. Restricted Products and Destinations

Certain products may be restricted based on their design, configuration, magazine capacity, intended use, or shipping destination.

Wildcat Systems reserves the right to:

- Decline orders to any jurisdiction where a product may be prohibited or restricted.
- Require additional information before accepting or fulfilling an order.
- Cancel an order when we cannot reasonably verify its legality.
- Restrict the quantity of products purchased.
- Discontinue shipping to particular states, territories, municipalities, addresses, or jurisdictions.

The ability to add an item to the cart or complete checkout does not constitute a representation or guarantee that the product is legal in your jurisdiction.

You may not export, reexport, transfer, or otherwise provide any Wildcat Systems product outside the United States in violation of applicable United States export-control laws or other legal requirements.

International orders are not accepted unless expressly authorized by Wildcat Systems in writing.

4. Compatibility and Third-Party Trademarks

Product listings may reference firearm models, manufacturers, equipment systems, or trademarks owned by third parties for the limited purpose of identifying product compatibility.

Unless expressly stated otherwise:

- Wildcat Systems is an independent company.
- Wildcat Systems is not affiliated with, sponsored by, authorized by, or endorsed by any third-party firearm or equipment manufacturer.
- Third-party names and trademarks remain the property of their respective owners.

Compatibility descriptions are based on the configurations identified in the applicable product listing. Manufacturers may revise their products without notice, and aftermarket modifications may affect compatibility.

Customers are responsible for reviewing all compatibility information before ordering. Contact Wildcat Systems before purchasing when compatibility is uncertain.

5. Product Descriptions and Manufacturing Variations

Wildcat Systems makes reasonable efforts to display product descriptions, dimensions, materials, colors, photographs, compatibility information, pricing, and availability accurately.

However:

- Screen settings, lighting, and photography may affect how product colors appear.
- Minor cosmetic variations may occur between production runs.
- Products manufactured through additive manufacturing or similar processes may exhibit visible layer lines, seams, texture variations, support-interface marks, or other minor manufacturing characteristics.
- Published weights and dimensions may include reasonable manufacturing tolerances.
- Product packaging may change without notice.

Minor cosmetic variation that does not materially affect safe function or intended performance is not necessarily a manufacturing defect.

Wildcat Systems reserves the right to improve or revise product designs, materials, specifications, packaging, and manufacturing processes without notice, provided that the delivered product remains substantially consistent with the purchased product description.

6. Installation and Safe Use

Firearms and firearm-related equipment can cause serious injury or death when handled, installed, maintained, or used improperly.

Before installing, adjusting, or inspecting any firearm accessory:

- Verify that the firearm is completely unloaded.
- Remove all ammunition from the immediate work area.
- Follow the firearm manufacturer’s safety procedures.
- Wear appropriate eye protection.
- Use the correct tools and installation procedures.

Installation should be performed by a qualified armorer, gunsmith, or other competent person when the customer lacks the necessary experience, tools, or training.

The customer is responsible for inspecting the product before use and after installation. Do not use a product that appears damaged, improperly fitted, excessively worn, or incompatible with the host firearm or equipment.

Unless expressly stated otherwise, Wildcat Systems products are not represented as suitable for law-enforcement duty use, military use, emergency rescue, life-support applications, or any application in which product failure could directly result in death or serious bodily injury.

The customer assumes responsibility for the selection, installation, inspection, maintenance, and lawful use of each product.

7. Orders and Acceptance

Submitting an order does not guarantee that the order has been accepted.

An order is accepted when Wildcat Systems confirms acceptance, begins fulfillment, or ships the product. An automated order-confirmation email only confirms that we received the order.

Wildcat Systems may refuse or cancel an order for reasons including:

- Product unavailability.
- Incorrect pricing or product information.
- Suspected fraud or unauthorized payment.
- Payment-processor rejection.
- Legal or regulatory concerns.
- Shipping restrictions.
- An incorrect, incomplete, or unverifiable address.
- A suspected reseller or bulk-purchasing violation.
- An error affecting the Site, checkout system, or inventory system.

If Wildcat Systems cancels an order after payment has been collected, an appropriate refund will be issued to the original payment method.

8. Prices, Taxes, and Payment

All prices are listed in United States dollars unless otherwise stated.

Prices may change at any time before an order is accepted. Wildcat Systems may correct typographical, pricing, discount, or inventory errors, including after an order has been submitted.

Applicable sales tax, shipping charges, and other fees will be calculated during checkout when required.

Payments are processed through Shopify and one or more third-party payment providers. Use of a payment method may also be subject to the payment provider’s terms and privacy practices.

By submitting payment information, you represent and warrant that:

- You are authorized to use the payment method submitted.
- The billing information provided is complete and accurate.
- Use of the payment method does not violate applicable law.
- You will pay all authorized charges associated with the order.

9. Shipping and Delivery

Current processing estimates, available shipping methods, destination restrictions, and related information are provided during checkout.

Processing times and delivery estimates are estimates and are not guaranteed unless expressly stated otherwise.

Wildcat Systems is not responsible for delays caused by circumstances outside our reasonable control, including:

- Carrier delays.
- Weather or natural disasters.
- Labor interruptions.
- Government actions.
- Transportation disruptions.
- Incorrect customer information.
- Payment or fraud reviews.
- Supply shortages.

Customers are responsible for providing a complete and deliverable shipping address. Additional shipping charges resulting from an incorrect or incomplete address may be charged to the customer.

Risk of loss and title for products pass to the customer as permitted by applicable law. This provision does not limit any rights the customer may have regarding lost, damaged, or improperly delivered packages.

10. Inspection After Delivery

Inspect all products promptly after delivery.

Contact Wildcat Systems as soon as possible if:

- The package was visibly damaged.
- An item is missing.
- You received the wrong product.
- The product appears defective.
- The package was marked delivered but cannot be located.

Keep the product, packaging, shipping label, and all included materials until the matter has been resolved. Photographs, measurements, or other documentation may be required.

11. Returns and Refunds

Returns and refunds are governed by the separately published Wildcat Systems Return and Refund Policy, which is incorporated into these Terms and Conditions.

Unless a product page or written warranty states otherwise, returns are generally accepted only for:

- A verified manufacturing defect.
- An incorrect item sent by Wildcat Systems.
- Material damage occurring before delivery.
- Another condition for which a return or remedy is required by law.

The customer must contact Wildcat Systems within 30 days after delivery before returning any product.

Wildcat Systems generally does not accept returns based solely on:

- A change of mind.
- Buyer’s remorse.
- Ordering the wrong model, size, or configuration.
- Failure to review published compatibility information.
- Normal cosmetic manufacturing characteristics.
- Damage caused by improper installation.
- Unauthorized modification.
- Abuse, neglect, misuse, or improper storage.
- Ordinary wear.

Products that have been installed, modified, drilled, cut, sanded, painted, stippled, chemically treated, overheated, or otherwise altered may not be eligible for return unless the claimed defect could not reasonably have been discovered before installation or modification.

Do not mail a return without first receiving authorization and return instructions. Unauthorized returns may be refused.

For an approved claim, Wildcat Systems may, subject to applicable law:

- Repair the product.
- Replace the product.
- Issue an appropriate refund.
- Provide another reasonable remedy.

Nothing in these Terms and Conditions limits consumer rights that cannot lawfully be waived.

12. Limited Product Warranty

Any express warranty applicable to a product will be stated on the applicable product page, in product documentation, or in a separate written warranty.

Unless expressly stated otherwise, warranty coverage does not include damage caused by:

- Improper installation.
- Use with an incompatible product.
- Unauthorized modification or repair.
- Abuse, misuse, negligence, or accidents.
- Excessive heat, chemical exposure, impact, or environmental damage.
- Failure to inspect or maintain the product.
- Use outside the product’s stated purpose.
- Normal wear or cosmetic deterioration.

Warranty service may require proof of purchase, photographs, return of the product, and information concerning the installation and host equipment.

13. Customer Accounts

You may have the option to create a customer account.

You are responsible for:

- Maintaining the confidentiality of your account credentials.
- Restricting access to your account.
- Providing accurate account information.
- Promptly notifying us of suspected unauthorized activity.

Wildcat Systems may suspend or close an account associated with fraud, abuse, prohibited conduct, excessive payment disputes, or violations of these Terms and Conditions.

14. Prohibited Uses

You may not use the Site to:

- Violate any law or regulation.
- Purchase products for an unlawful purpose.
- Misrepresent your identity, age, location, or legal eligibility.
- Circumvent geographic or product restrictions.
- Interfere with the operation or security of the Site.
- Introduce malware or malicious code.
- Scrape, harvest, or extract data without authorization.
- Infringe intellectual-property rights.
- Submit fraudulent orders or payment disputes.
- Reverse engineer or reproduce proprietary product designs.
- Manufacture counterfeit or unauthorized copies of Wildcat Systems products.
- Use Site content for unauthorized commercial purposes.
- Harass Wildcat Systems personnel or other users.

15. Reviews and Submitted Content

When you submit a product review, photograph, testimonial, suggestion, or other content, you represent and warrant that:

- You own or control the submitted content.
- The content is accurate and based on genuine experience.
- The content does not infringe another person’s rights.
- The content is not unlawful, threatening, defamatory, obscene, fraudulent, or misleading.

You grant Wildcat Systems a nonexclusive, worldwide, royalty-free license to use, reproduce, display, format, and distribute submitted content for business, promotional, and operational purposes.

Wildcat Systems may remove submitted content at its discretion, subject to applicable law.

16. Intellectual Property

The Site and its content, including product names, product designs, photographs, graphics, written descriptions, branding, logos, technical information, page layouts, and other materials, are owned by or licensed to Wildcat Systems and are protected by applicable intellectual-property laws.

You may use the Site only for personal, lawful shopping and informational purposes.

Nothing in these Terms and Conditions transfers ownership of any Wildcat Systems intellectual property.

No product purchase grants permission to reproduce, reverse engineer, manufacture, distribute, or commercially exploit a product or its design.

17. Third-Party Services

The Site is hosted through Shopify and may rely on third-party services for:

- Payment processing.
- Fraud prevention.
- Shipping.
- Analytics.
- Marketing.
- Customer communications.
- Product reviews.
- Website functionality.

Wildcat Systems does not control every third-party service and is not responsible for independent third-party websites, terms, privacy practices, or service interruptions.

18. Disclaimer of Warranties

Except for any express written warranty provided by Wildcat Systems, and to the maximum extent permitted by law, the Site and its content are provided on an “as available” basis.

Wildcat Systems does not warrant that:

- The Site will always be uninterrupted or error-free.
- Every product will be appropriate for every intended application.
- Every third-party product will remain compatible after manufacturer revisions.
- All website errors will be corrected immediately.
- Product descriptions or compatibility information will be free from every typographical or technical error.

Nothing in this section excludes any warranty or consumer protection that cannot legally be excluded.

19. Limitation of Liability

To the maximum extent permitted by law, Wildcat Systems will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Site or a product, including loss of profits, data, business opportunity, or use.

To the maximum extent permitted by law, Wildcat Systems’ aggregate liability relating to a product will not exceed the amount paid for the product giving rise to the claim.

These limitations do not apply to liability that cannot lawfully be limited, including liability arising from fraud, willful misconduct, gross negligence, or other nonwaivable obligations.

Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to every customer.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Wildcat Systems and its owners, officers, employees, contractors, and agents from third-party claims arising from:

- Your unlawful use of the Site or a product.
- Your violation of these Terms and Conditions.
- Your infringement of another party’s rights.
- Your unauthorized modification, resale, export, or misuse of a product.
- False information provided in connection with an order.

This provision does not require indemnification for conduct for which Wildcat Systems is legally responsible.

21. Force Majeure

Wildcat Systems is not responsible for a failure or delay caused by events outside our reasonable control, including natural disasters, severe weather, fire, war, civil disorder, government action, epidemics, labor interruption, carrier disruption, utility failure, cyberattack, or supply-chain interruption.

22. Governing Law and Venue

These Terms and Conditions are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

Subject to any nonwaivable consumer rights, any legal proceeding relating to these Terms and Conditions, the Site, or a purchase must be brought in a state or federal court with jurisdiction in or serving Cabarrus County, North Carolina.

Before filing a claim, the parties agree to make a reasonable good-faith effort to resolve the dispute informally.

23. Changes to These Terms and Conditions

Wildcat Systems may update these Terms and Conditions from time to time.

The revised version will be posted on the Site with an updated effective date. Changes apply prospectively unless applicable law permits otherwise.

Your continued use of the Site after an update constitutes acceptance of the revised Terms and Conditions.

24. Severability

If any provision of these Terms and Conditions is found to be unlawful or unenforceable, the remaining provisions will remain in effect.

The unenforceable provision will be modified or enforced to the greatest extent permitted by law.

25. Entire Agreement

These Terms and Conditions, together with the Wildcat Systems Privacy Policy, Shipping Policy, Return and Refund Policy, and any product-specific written terms, constitute the entire agreement between you and Wildcat Systems concerning use of the Site and purchases from us.
